Balcony West Terms of Service – $129 Coworking Membership

Effective Date: May 22, 2026

Welcome to Balcony West.

These Terms of Service (“Terms”) constitute a legal agreement between you and Balcony West (“Balcony West,” “we,” “our,” or “us”) governing your access to and use of Balcony West locations, memberships, events, website, applications, and related services (collectively, the “Services”).

By creating an account, purchasing a membership, accessing our spaces, attending events, using our website, or clicking “I agree,” you acknowledge that you have read, understood, and agreed to these Terms.

If you do not agree to these Terms, you may not access or use the Services.


1. Membership & Access

Balcony West provides members with access to community, workspace, hospitality, programming, and related amenities subject to membership tier availability and operational policies.

Membership benefits, pricing, operating hours, and included amenities may change from time to time.

Membership is personal and non-transferable unless expressly authorized in writing by Balcony West.

We reserve the right to deny, suspend, or terminate membership or access at any time for violations of these Terms, community standards, safety concerns, misuse of the space, nonpayment, or conduct that negatively impacts members, guests, staff, or the Balcony West experience.


2. Community Standards

Members and guests are expected to behave respectfully and professionally.

The following are prohibited:

  • Harassment, discrimination, threats, or abusive behavior
  • Excessive noise or disruption
  • Damage to property
  • Unauthorized commercial activity
  • Illegal activity
  • Unauthorized access to restricted areas
  • Use of the space in a manner that interferes with other members’ enjoyment or safety

Balcony West reserves sole discretion in determining whether conduct violates these standards.


3. Guest Policy

Guests can attend with a member free of charge and are treated like members. Guests should be accompanied at all times in the space, and members will be held accountable for their guests’ actions in the space. In the instance that the guest policy is being taken advantage of or otherwise abused, Balcony West reserves the right to ask members to refrain from bringing guests or ask that guests consider purchasing their own membership.


4. Events & Programming

Balcony West may host social, professional, educational, wellness, or hospitality-related events.

Participation in events is voluntary and at your own risk.

Certain events may require separate registration, waivers, age restrictions, or additional fees.

Balcony West reserves the right to photograph, record, or document events for promotional or operational purposes.


5. Payments & Billing

By providing payment information, you authorize Balcony West and its payment processors to charge all applicable membership fees, recurring subscription fees, event fees, taxes, penalties, and related charges.

Memberships automatically renew unless canceled before the next billing cycle.

Failed or declined payments may result in suspended access, late fees, or membership termination.

You are responsible for maintaining accurate billing information.


6. Cancellation & Refunds

You may cancel your membership at any time through your member account portal or by contacting Balcony West support.

Unless otherwise stated:

  • Monthly memberships remain active through the current billing period
  • Membership fees are generally non-refundable
  • Partial-month refunds are not provided
  • Promotional, discounted, or annual memberships may be non-refundable

Balcony West may, at its sole discretion, issue refunds or credits in exceptional circumstances.


7. Code of Conduct

You agree not to:

  • Use Balcony West for unlawful purposes
  • Interfere with the operation or security of the Services
  • Misrepresent your identity
  • Share account credentials
  • Use the Services to harass, exploit, or harm others
  • Bring hazardous materials, weapons, or illegal substances onto the premises

Balcony West may immediately suspend or terminate access for violations.


8. Alcohol, Drugs & Smoking

Unless expressly permitted during Balcony West-sponsored events:

  • Illegal drugs are prohibited
  • Smoking and vaping are prohibited indoors
  • Excessive intoxication or disruptive conduct is prohibited

Balcony West reserves the right to remove individuals from the premises for safety or policy violations.


9. Weapons Policy

Weapons of any kind are prohibited on Balcony West property except as expressly permitted by applicable law and authorized in writing by Balcony West.

Balcony West reserves the right to deny entry or remove individuals for safety reasons.


10. Filming, Photography & Recording

To protect member privacy and experience:

  • Unauthorized commercial filming or photography is prohibited
  • Recording other members without consent is prohibited
  • Balcony West may record portions of the premises for operational, security, or promotional purposes

By entering Balcony West locations or attending events, you acknowledge that you may appear incidentally in photos or recordings.


11. Security Cameras & Monitoring

Balcony West may use video surveillance and related monitoring systems for safety, operational, and security purposes.

By accessing our spaces, you consent to such monitoring where permitted by law.


12. Stuff and Lost & Found

Personal Items: Do not leave your laptops, backpacks, or equipment unattended, as Balcony West does not hold liability for lost or stolen gear. You may not store or leave anything at Balcony West or it will be treated as lost and likely disposed of.

Food & Drink: No full meals are permitted inside the workspace, though snacks and their complimentary coffee/tea are perfectly fine.

Lost items may be retained for a limited period determined by Balcony West.

Unclaimed items may be discarded, donated, or otherwise disposed of after the retention period.

Balcony West is not responsible for lost, stolen, or damaged property.


13. Pets

Only service animals permitted by law are allowed unless otherwise approved by Balcony West.

Members remain responsible for their animals at all times.


14. Intellectual Property

All Balcony West branding, content, software, logos, materials, designs, and related intellectual property are owned by Balcony West or its licensors.

You may not reproduce, distribute, modify, reverse engineer, or commercially exploit Balcony West materials without prior written consent.


15. User Content

If you submit feedback, reviews, suggestions, images, posts, or other content to Balcony West, you grant Balcony West a non-exclusive, worldwide, royalty-free license to use, reproduce, display, modify, and distribute such content in connection with the Services and marketing.

You represent that you have the rights necessary to provide such content.


16. Privacy

Your use of the Services is also governed by our Privacy Policy.

By using the Services, you consent to our collection and use of information as described in the Privacy Policy.


17. Assumption of Risk

You understand that use of coworking, hospitality, event, and social spaces involves inherent risks, including personal injury, illness, theft, property damage, and interactions with other individuals.

You voluntarily assume all risks associated with participation in Balcony West activities and use of Balcony West facilities.


18. Release & Limitation of Liability

To the maximum extent permitted by law, Balcony West and its owners, affiliates, employees, contractors, agents, partners, and licensors shall not be liable for:

  • indirect or consequential damages
  • lost profits
  • business interruption
  • data loss
  • theft or property damage
  • personal injury arising from use of the Services

Balcony West’s total liability for any claim shall not exceed the amount paid by you to Balcony West during the three (3) months preceding the claim.


19. Indemnification

You agree to defend, indemnify, and hold harmless Balcony West and its affiliates, employees, agents, and partners from any claims, liabilities, damages, losses, or expenses arising from:

  • your use of the Services
  • your guests
  • your violation of these Terms
  • your negligence or misconduct

20. Termination

Balcony West may suspend or terminate access to the Services at any time and for any reason permitted by law.

Termination does not relieve you of outstanding payment obligations or liabilities incurred prior to termination.


21. Changes to Terms

Balcony West may update these Terms from time to time.

Updated Terms become effective upon posting to the website.

Continued use of the Services after updates constitutes acceptance of the revised Terms.


22. Governing Law

These Terms shall be governed by the laws of the State of Colorado, without regard to conflict of law principles.

Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Denver County, Colorado.


23. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.


24. Entire Agreement

These Terms constitute the entire agreement between you and Balcony West regarding the Services and supersede prior agreements or understandings relating to the subject matter herein.
