BW Hyper Local™ Business Address License Agreement
Effective Date: July 11, 2026
Welcome to BW Hyper Local™. This Business Address License Agreement (“Agreement”) governs your purchase and use of the BW Hyper Local™ Package offered by Balcony West LLC (“Balcony West,” “we,” “our,” or “us”). By purchasing the BW Hyper Local™ Package, checking the acceptance box during checkout, or using the services, you agree to be bound by this Agreement.
1. Nature of Agreement
The BW Hyper Local™ Package provides Member with a limited, revocable, non-exclusive license to use an assigned Balcony West business address during the term of this Agreement.
This Agreement is a license only.
Nothing contained herein shall be construed as creating:
- a landlord-tenant relationship;
- a lease of real property;
- any ownership interest in the premises; or
- any exclusive right to occupy any office or workspace.
Balcony West retains sole ownership and control of all premises.
2. Initial Term
The initial term of this Agreement is eighteen (18) months beginning on the activation date.
Member agrees to remain financially responsible for all monthly payments throughout the Initial Term.
Following expiration of the Initial Term, this Agreement shall continue month-to-month unless terminated by either party upon thirty (30) days’ written notice.
3. Fees
Membership fee:
$299.00 per month
To activate service, Member must prepay:
- First month
- Second month
- Third month
for a total initial payment of $897.00, plus applicable taxes.
$897 would be refunded if GMB address cannot be verified. This is the only instance of a refund, no other refunds will ever be issued for any reason.
4. License to Use Address
During the active term only, Member may use the assigned BW Hyper Local™ business address for legitimate business purposes including:
- business correspondence;
- state registrations;
- marketing materials;
- website contact information;
- Google Business Profile (subject to Google’s policies);
- Apple Maps;
- Bing Places;
- Yelp;
- professional licensing records;
- client communications.
Member receives no ownership interest in the address.
5. Business Presence Requirement
Balcony West provides a legitimate business location.
Member acknowledges that BW Hyper Local™ is intended for businesses that maintain a genuine business presence at Balcony West. Member agrees to cooperate with reasonable requests necessary to verify occupancy or business presence, including periodic verification required by online directory providers. Failure to maintain a legitimate business presence or misuse of the licensed address may result in immediate termination.
Google independently determines eligibility under its own policies.
Member is solely responsible for complying with all Google Business Profile Guidelines.
6. Required Removal of Address
Immediately upon expiration or termination of this Agreement, Member shall permanently discontinue all use of the Balcony West address.
Within five (5) calendar days, Member shall remove the Balcony West address from all locations including but not limited to:
- Google Business Profile;
- Google Maps;
- Apple Maps;
- Bing Places;
- Yelp;
- Facebook;
- LinkedIn;
- websites;
- online directories;
- Secretary of State filings;
- advertising;
- invoices;
- estimates;
- business cards;
- stationery;
- email signatures;
- vehicle graphics;
- uniforms;
- social media;
- printed marketing materials; and
- any other public or private listing.
7. Authorization to Notify Third Parties
If Member fails to remove the address following termination, Member expressly authorizes Balcony West to notify:
- Google;
- Apple;
- Microsoft;
- Yelp;
- online directories;
- postal authorities;
- licensing agencies; and
- any other appropriate third party
that Member is no longer authorized to use the Balcony West business address.
Member acknowledges Balcony West may provide copies of this Agreement or other documentation demonstrating termination.
8. Unauthorized Continued Use
Any continued use of the Balcony West address after termination constitutes a material breach of this Agreement.
Balcony West may seek:
- immediate injunctive relief;
- monetary damages;
- recovery of attorney fees where permitted by law; and
- any other remedies available under Colorado law.
9. Mail Handling
Mail acceptance is available only while this Agreement remains active.
Following termination Balcony West may:
- refuse delivery;
- return mail to sender;
- mark mail “Not at this Address”;
- discontinue accepting deliveries.
Balcony West is not responsible for lost or delayed mail after termination.
10. Acceptable Use
Member agrees not to:
- engage in illegal activity;
- misrepresent occupancy;
- use the address fraudulently;
- interfere with other Members;
- damage Balcony West’s reputation.
Balcony West may immediately terminate this Agreement for violations.
11. Limitation of Liability
Balcony West shall not be liable for:
- search engine rankings;
- Google Maps visibility;
- loss of customers;
- SEO performance;
- postal delays;
- third-party platform decisions.
Maximum liability shall not exceed the total fees paid during the preceding three (3) months.
12. Governing Law
This Agreement shall be governed exclusively by the laws of the State of Colorado.
Venue shall lie exclusively in Denver County, Colorado.
13. Entire Agreement
This Agreement constitutes the entire agreement regarding the BW Hyper Local™ Package and supersedes all prior representations relating to the services.
Balcony West may revise these Terms by posting updated Terms on its website. Continued use of the services after such revisions constitutes acceptance of the revised Terms.
